The rule
Under the Privacy Act, "sensitive information" is a category of personal information, and the OAIC lists health information in it. Sensitive information gets more protection than other personal information.
What it means for your clinic
- Treatment history, consult notes, before and after photos and consent forms are health information.
- Anything that confirms someone had a treatment, such as a review reply that names it, discloses health information.
